Standard Terms and Booking Conditions

Thank you for your interest in staying at one of our vacation rentals, we are confident that you will enjoy the properties as much as we and our many guests do. Please read these Terms and Conditions carefully, they contain important information about your holiday contract.

By proceeding with a reservation it is deemed that you and other persons that accompany you have read, understood and accepted these terms and conditions.

1. CONTRACT

Your rental contract is with Nigel Stringer and Beverly Herrington of Villa Vida Nova CC111B Ceiceira, 8550-245 Monchique Portugal who are owners of Villa Vida Nova, Algarve, Villa Vida Nova Silver Coast and Villa Sunrise Silver Coast.

2. PAYMENT FOR YOUR HOLIDAY

A deposit of 25%, or other amount as agreed, of the total cost of your holiday accommodation is required at the time of booking. The balance and Refundable Damage Deposit (RDD) is due 12 weeks prior to the check in day of the rental period. If the booking is made less than 12 weeks before departure, the full amount is due on booking. If any balance remains unpaid, we reserve the right to treat your booking as cancelled and apply the cancellation charge set out below.

Payment of the deposit, and the balance and RDD will be by way of Secure Payment by bank transfer or debit or credit card via Wise.

The deposit must be paid within 24 hours of receiving your booking confirmation.

3. AMENDMENT AND CANCELLATION BY YOU

3.1 AMENDMENT

We will do our best to assist in altering your arrangements after booking but cannot guarantee this will always be possible. If alterations can be made you will be responsible for paying any difference if the amended rental period rate is higher.

3.2 CANCELLATION 

Deposits are not refundable however we will try our utmost to resell the week/s, if we can do this we will refund your deposit in full less any discount or incentives that we may have to offer to enable the resale.

If after paying the balance amount and RDD you cancel within the following periods leading up to your vacation:

9-12 weeks 50% of the balance paid and your RDD will be refunded.

6-9 weeks 25% of the balance paid and your RDD will be refunded.

0-6 weeks only your RDD will be refunded.

A Euro 50 administration fee will also be applied.

There are many travel interruption insurance policies that have been made available to the public, we strongly recommend that your party subscribe to one for the entire duration of their vacation.

 

4. AMENDMENT OR CANCELLATION BY US (that is not caused by “Force Majeure”).

In the very unlikely event that we are required to amend or cancel your booking then you will be compensated by having the following options made available to you. (i) alternative week/s during the March – November period in the year that you have booked or the following year, depending on availability, (ii) an alternative villa, of same rental value, or (iii) cancelling your holiday. If cancellation is your choice then we will promptly refund all monies received from you.

5. FORCE MAJEURE

Compensation will not be made in any cases where an amendment, change or cancellation is due to “force majeure”, being unusual or unforeseeable events or circumstances beyond our control, the consequences of which we could not reasonably avoid. These include, but are not limited to, war, threat of war, riot, civil disturbance or strife, pandemics, terrorist activity (actual or threatened), industrial disputes, strikes, technical or maintenance problems with transport, machinery or equipment, utility failure, natural or nuclear disaster, fire including wild fires, flood, subsidence, drought, adverse weather conditions, levels of water in rivers, acts of God, government intervention, political uncertainty or instability, cyber attack, closure of airports or ports, closure of borders, changes of schedules or operational decisions of transport providers.

6. WEEKLY RATES

We rent the properties by the week starting on Saturdays, we do not rent part weeks, (unless otherwise agreed). All weekly rates advertised or quoted are for the property per week (7 nights) and are in Euros (unless otherwise agreed) and are fully inclusive of IVA (VAT) tax, and are subject to change, up or down, until the booking is concluded and deposit paid. After that, (in the unlikely event), we reserve the right to increase or decrease the price to reflect increases or decreases in government approved taxes and or above normal inflation*. (see last paragraph below).

6.1 GUEST LIMITATIONS

Only those persons named on the booking form shall be allowed to occupy the accommodation and under no circumstances may the maximum number of persons, six, be exceeded, except for the addition of children under 3 years who can occupy a cot. Failure to comply with this will result in possible eviction and forfeiture of your Refundable Damage Deposit. We do not accept Hen, Stag or same gender parties, film or photographic shoots.

7. CHECK IN AND CHECK OUT TIMES

7.1 Check in is not before 4.00 pm on the Saturday, we need to give staff uninterrupted time to clean and prepare the villa to tip top condition, however you can drop luggage off whilst you go and have lunch or go and buy groceries. If you find yourselves still too early having done all that then you are welcome to relax at the pool whilst she finishes off.

7.2 Check out Saturdays 10.00 am, sorry, no exceptions. Our staff had at least 6 hours to clean, sanitise and prepare the villa for your arrival and so it is only fair to give the same for our next guests. Failure to comply will incur a service fee. If you have a late flight let me know so that I can make some suggestions for you to maximise the rest of the day.

8. SMOKING. CANDLES AND RISK OF FIRE.

The properties are strictly non-smoking, this includes e-cigarettes/vapes. However smoking and use of e-cigarettes/vapes is permitted outside the properties, please use the ashtrays provided in the BBQ area. Do not dispose of cigarette buts anywhere except in the ashtrays. Failure to observe this will incur a special cleaning charge to eliminate stale cigarette odours from the villa.

For insurance reasons and the safety of all our guests, candles are forbidden anywhere on the property. Candles are one of the major causes of domestic fires.

9. OUR RESPONSIBILITIES TO YOU

We take care to ensure that all involved in the preparation of our properties maintain them to the highest Portuguese standards and for your convenience. There is a "Property Directory” available and it is understood that all members of your party read and apply the rules and suggestions made therein to ensure your personal safety and full enjoyment.

9.1 We will pay reasonable compensation (subject to 10. below) if the properties are not of the standard described or contracted by you. This compensation will be limited to no more than the pro rata rental price of the person/s affected.

9.2 Our liability to you does not apply in the case of insignificant issues that do not materially detract from your use of the villa nor in the event of “Force Majeure” or if you or any member of your group is at fault or negligent; if the failure is the fault of someone else not connected with providing the services which form part of your contract with us; the failure is due to any unusual or unexpected circumstances beyond our control, which we could not have avoided even if we had used all care possible or the failure is due to any event which we or the supplier of any service could not help, or an alternative to such service is unavailable, expect or prevent.

9.3 Any acceptance of liability is subject to you agreeing to assign to us your rights against any third party responsible for the events leading to your claim and to you affording us all necessary assistance in pursuing that claim.

9.4 From time to time we may offer vouchers or discounts at or for 3rd party venues, they are considered to be a non contractual bonus and if discontinued or not honoured, for any reason, then whilst unfortunate, no compensation will be made.

10. COMPLAINTS

If you have a problem during your holiday, please in the first instance inform us by email nige@sapo.pt or telephone +351 91 906 4376 where we will endeavour to put things right as quickly as possible. It is strongly suggested that you communicate any complaint without delay so that action can be taken straight away. Failure to do so will deprive us of the opportunity to investigate and rectify your complaint and this may affect your rights under this contract.

11. TERMINATION AND INDEMNITY

You must accept responsibility for the proper conduct of yourself and any members of your party whilst using the properties. In cases of serious misconduct, we reserve the right to terminate your contract and insist that you immediately vacate the property. If we do so, we shall have no further responsibility or liability to you. If you or any member of your party wilfully, recklessly or negligently cause any damage to any accommodation, property or person, you agree to indemnify us against any loss suffered by us (including legal costs), arising from such damage.

12. REFUNDABLE DAMAGE DEPOSIT (RDD)

A refundable deposit of Euro 300 per booking, (equivalent in other currency as agreed), minor breakage and accidental damage charge, will be added to all bookings. This will be payable at the time of your balance payment. The charge covers accidental damage to fixtures and fitting and breakages to crockery and glassware. This does not cover malicious damage or misuse of the fixtures and fittings or structure of the properties by you or members of your party. The properties will be inspected on the day of your departure, the cost of any damage will be verified and deducted from this amount, the balance or the whole amount as the case may be will be refunded by way of bank transfer usually within 3 to 4 working days (if you have booked through a 3rd party this period may be longer), of your departure date. Any damage caused in excess of the RDD must be paid by you within 4 weeks of receiving our invoice for repair or replacement. We strongly suggest that you have insurance against such an event.

Removal of garbage is your responsibility including the day of departure, there is a green public “Lixo” (garbage) bin at the top of the lane for Villa Vida Nova and one 50 meters to the south of Casa Vida Nova. Similarly the washing of dishes is also your responsibility including breakfast dishes on the day of departure, failure to comply will incur a charge.

We ask you to leave the property in the condition you found it on your arrival and report any damages or breakages caused during your stay.

13. INSURANCE

Rental of these properties does NOT include travel insurance or any type of liability insurance for you or members of your party, including your possessions, it is your responsibility to ensure you have adequate insurance cover. Such insurance should cover any probable loss through damage to any part of the property or fixtures and fittings, cancellation, amendment, accident or health related problems and any loss incurred by Force Majeur. 14. JURISDICTION

This contract is governed by Portuguese Law and is subject to the exclusive jurisdiction of the courts of Portugal.

15. ADDITIONAL INFORMATION

The properties are not suitable for Hen, Stag or similar same gender parties, film or photographic shoots. These groups or activities are strictly forbidden.

The properties are strictly Non Smoking, however smoking is permitted outside please use ashtrays provided in the BBQ area. Failure to observe this will incur a charge to eliminate stale cigarette odours.

For insurance purposes and your safety candles are forbidden.

Maximum occupancy is 6 persons and 2 children of cot sleeping age.

We do not provide welcome packs. We started out providing a typical welcome pack, bread, butter, milk, tea. coffee, ham, cheese, salt, pepper, juice etc. Our clients are from different continents, nationalities and cultures and expected items that they were used to, not what we provided. Couple this with Covid recommendations, lactose free, gluten free, peanut free, Vegan, Halal, Kosher and who drinks regular tea anyway, more than half the pack was wasted!  Food intolerances have increased dramatically over the last few years so there are also health and liability issues to consider. So that we do not offend any of our guests we decided to replace the welcome pack with  complimentary wine, guess what, no waste any more and every one is happy!

On that point, we do encourage our guests to place in a basket for the next guests non perishable items rather than throw them out when they leave. 

Villa Vida Nova Algarve has stairs to the first floor and there are stairs from the car park to the villa and so is not suitable for wheel chairs or the very infirm. Villa Vida Nova and Villa Sunrise on Silver Coast are both accessible by wheel chair and have one bedroom and bathroom on the ground floors. 

The road to Villa Vida Nova Algarve is steep to walk up, it is far easier to drive. Although the nearest restaurant and bars are just a few hundred meters away allow a good 5-10 minutes if walking when it is hot.

Diving and jumping into the swimming pools can be dangerous and is therefore forbidden.

Walking or sitting on the weir wall or lower canal wall of the infinity pool at Villa Vida Nova Algarve is also forbidden.

Glassware must not be taken within 5 meters of the swimming pools as broken glass that may enter the pool becomes invisible and obviously dangerous to you and subsequent guests. The pools are cleaned regularly but broken glass may not all be removed.

There is a swimming pool and also a grotto at Villa VIda Nova Algarve with water in it so children under the age of 16 must be supervised at all times.

Persons of any age who cannot swim must be supervised when in the pools.

Children of all ages are welcome, we have cots and a high chairs if required.

A car is recommended for Villa Vida Nova Algarve the Serra da Monchique is hilly, great for walking and views, so a car rental is a good idea to get around. Many of the secondary roads are narrow and winding so take your time as they afford some incredible views if you go and explore.

Sorry no pets. The properties are and always have been pet free, ideal for folks with related allergies.

The Government may introduce a "tourist tax" for all visitors who stay in either location similar to what exists in Lisbon and Porto. It is is not finalized yet but may come into effect in the near future. The proposal at present is Euro 1.50 per adult per night payable for the first 7 nights. More about this when it is legislated.

At villa Vida Nova Algarve there is a twin bed suite on the ground floor for those who cannot manage too many stairs and similarly at Villa Vida Nova Silver Coast there is a king suite on the ground floor.

There are stairs from the car parking area to the Villa Vida Nova Algarve, these are wide, gradual with a landing and have hand rail. Everything else is on the level save for the two upstairs master bedrooms.

All properties are in semi-rural areas where there are, forests and small farms so do expect to hear farm noises from time to time, chickens, guinea fowl, owls, dogs, tractors, chain saws, strimmers, etc. Once or twice a month for just a minute or so and depending on the direction of the wind you may hear muffled bangs from a distant stone quarry.

Our manager, cleaners, pool cleaners and gardeners will attend to the properties  from time to time, they will keep out of your way as much as possible. Exterior work is weather dependant so times may vary. The cleaner may need to use the washing machine on her visits.

Some electronics, decor items and particularly sunbeds, seat covers and parasols may differ slightly from the photographs on our websites as we need to replace them from time to time due to wear and tear and as we make general improvements.

Tip: Ensure that your car rental company will provide a transponder for the toll roads, this will enable tolls to be paid automatically for the duration of your vacation. Without a transponder payment is difficult and payment cannot be made for the return trip to the airport.

It is important to distribute these terms and conditions to all members of your party staying at the properties.
